Rajasthan Advocates Protection Bill, 2023
In Rajasthan, a bill was passed in the State Legislative Assembly to prevent violence against lawyers and to pay compensation to advocates by recovering compensation amount from criminals involved in such crimes.
The Bill seeks to prevent assault, grievous hurt, criminal force and criminal intimidation against an advocate in the discharge of their duties.
With this law, advocates will be able to get protection against violence.
According to this bill, the deputy SP rank officer will investigate the attack on the lawyer. The report has to be given in 7 days. The accused of assault will be imprisoned for 2 years and fined Rs 25,000. There is a provision of imprisonment for 7 years in suicide attack.
Main Provisions –
- Maximum 7 years of imprisonment and 50 thousand rupees fine For causing serious injury to the lawyer.
- 2 years imprisonment for assault and there will be a fine of Rs.25,000.
- Punishment for two years for criminal force and intimidation.
- All offenses shall be cognizable. shall be compoundable under section 6-7.
- In addition to the punishment, the offender shall also be liable to pay damages to the property of the advocate. If any criminal damages the property of the advocate, then the compensation fixed by the court will be recovered and given to the aggrieved advocate. The speedy recovery of this amount will be done on the lines of arrears of land revenue.
The Bill also proposes to punish lawyers. Provision of 2 years imprisonment to the lawyer for misusing the provision of the Act.
